Project initiation

The initiation of a project requires (1) a signed Project Agreement Contract, (2) the first installment or the complete payment of the total cost, and (3) all content that is to be used in the project. Content is the textual or visual content that is encountered as part of the user experience.

Payment

Payment must be made in full if the total cost of the project is less than $1,000. If the total exceeds $1,000, the first non-refundable installment of an agreed-upon payment plan is due upon project initiation. The details of a payment plan will be specified in the Project Invoice. Unless otherwise agreed, websites will not be pushed live and other work will not be handed over for use until the final payment is made.

Availability

The BRDG team is available Monday through Friday 8am - 4pm Mountain Standard Time. All calls must be booked through our scheduler. To provide balance, the team is unavailable for spontaneous contact on Saturdays and Sundays. Any phone calls made or emails sent during the weekend will be promptly responded to on the next workday. Weekend meetings and calls can be scheduled in advance.

Timeliness requirements for clients

Projects can be hindered if the client does not provide required elements or feedback in a timely manner, such as copy, imagery, appropriate account login information, feedback on a design mockup, etc. For that reason, if BRDG is waiting for content or communications, the client will be notified. Delays may result in the project being pushed back and other work taking priority.

Client-Provided Content — After the signing of the Project Agreement Contract, the client must provide BRDG with all of the content needed by the agreed upon start date for the project. If delays caused by the client result in an inability to hit a hard deadline, BRDG cannot be held responsible. The amount of time stated in the Project Agreement Contract will remain the same and the deadline will be moved.

Feedback – If the client does not give feedback on delivered work within 10 business days, by default, the work is approved. Later, if the client requests changes to the work, additional charges may apply.

Extended Delays – If more than 30 days have passed since the client signed the initial Project Agreement Contract and there has been no communication from the client, BRDG will consider the project complete in its entirety and bill for the completed project.

Submitting content

All content must be submitted electronically via email or through a shared cloud folder. Text must be selectable as actual text rather than as flattened images. Both text and photos/graphics must be clearly labeled with the desired placement. Content may not be submitted via fax or paper copies. Exceptions to this policy must be approved in advance.

Unless the client has hired BRDG for content development, all text and photos used as content in commissioned work must be provided by the client. The client must have ownership or written permission to use all content he/she provides for use. It is up to each client to ensure his/her content does not infringe on any trademark, service mark, or copyright. BRDG cannot be and is not responsible for intellectual property infringements on behalf of clients.

Late fees

If the payment is not made within 10 business days, an additional 10% of total outstanding balance will be added to the sum due for every 10 business days of delinquency. Payment not received within 30 days of the due date will be considered a closed account, thus nullifying the work agreement, entitling the client to no Rights to said work(s), and no refunds. Balances that are not paid within 30 days will be reported to a credit bureau. Balances that are not paid within 60 days will be turned over to a collection agency.

Copyright

Subject to the Portfolio Rights below, BRDG grants to the client the exclusive, perpetual, and worldwide rights to reproduce, display, distribute, and create derivative works based on the selected completed work in all media. All preliminary, unused, and in-progress work remains the property of BRDG and no rights to use such preliminary works are granted here under. Under U.S. Copyright law, BRDG retains all copyrights in and to the preliminary works and the completed work.

Portfolio rights

BRDG, along with any partnered Contractors, retain the non exclusive, perpetual, and worldwide right to display, reproduce, and distribute the work in their portfolios, websites, and third-party trade publications or exhibits, solely for the purpose of promotion, and the right to be credited with copyright ownership and authorship of the work in connection with such use. The portfolio images that are posted online may sometimes differ from the final product to best display the BRDG team’s taste.

Ownership of domain names

Website domain names are leased from domain name registration companies. When BRDG registers a domain name for a client, that registration will be made in the client’s name. Upon full payment of any outstanding fees, the client has the right to use that domain name regardless of whether he/she chooses to continue further services with BRDG. Domain name renewal and renewal fees are 100% the responsibility of the client. Clients are advised to closely monitor the renewal date of a registered domain name and to verify that the renewal of said domain name has been completed. BRDG cannot be held responsible for expired domain names.

Search engine results disclaimer

Every client would like his/her website to rank high in search engine results for selected keywords, yet search engine results are determined by a multitude of factors that frequently change. BRDG guarantees certain search-engine friendly techniques will be used in the creation of custom websites, such as keywords in the title bar at the top of the browser, the meta tags in the hidden coding behind the scenes, the alternate text behind some images, and in the formatting of blog articles. BRDG cannot be held responsible for search engine results.

Third-party vendors

BRDG cannot be held liable for disputes with third-party vendors, regardless of whether or not the service is part of a reseller agreement or referral. BRDG cannot be held responsible for lack of functionality or any other aspect of third-party services. It is recommended that clients conduct proper research and read all third-party vendor policies before beginning service.

Revisions

The client is promised the amount of revisions stated in the Project Outline. If revisions are not included with the service, adjustments will be made at the rate of $2/min. If the client develops preferences, changes his/her mind, or makes additional requests during or after the completion of the work, additional time must be purchased. All content should be collected and finalized and all preferences – such as the style, the color scheme, and the functionality – should be specified prior to approval and commencement of any development.

Revision charges are determined after the edits have been completed. The BRDG teammate responsible for the edits will use a time tracking software to accurately record how much work was done. All teammates known to focus solely on a single project during revision phases. A screen recording of the work can be provided to the client, but the request for one must be made before the work begins, as the BRDG team does not possess the talent of time travel.

Refunds

BRDG does not offer refunds for differences in opinion. When BRDG is hired, the client chooses the team’s education, experience, taste, and desire to match today's industry standards and customer expectations. BRDG is not responsible to revise or refund the project, if the client disagrees with the creative decisions made by BRDG or the strategies and ideas that BRDG suggests.

Termination

If the client changes his/her mind about doing work with BRDG during the course of the initial development phase, no refunds will be issued and the client will be responsible for the amount of completed work. In order to protect clients from unintentional service interruption, clients wishing to terminate any services must request the service termination in writing.

Refusal of service

BRDG does not accept projects that promote hate, discrimination, exploitation, or any other unethical practice. BRDG does not tolerate disrespectful, abusive, or manipulative behavior to any of its team members or partners. BRDG reserves the right to decline to do business with any client for any reason. All non-refundable payments shall live up to their name.

Quality

BRDG makes an effort to ensure that every aspect of its service is to the client’s liking, but it cannot control every variable. BRDG cannot be and is not responsible for any perceived loss of revenue under any circumstances.

Changes to terms

BRDG reserves the right to change these terms of service at any time for any reason. If these terms are revised after a project begins, the changes will not apply to it.

We would never force you into an unexpected situation that you didn’t sign up for.
